3. Credits and Payments

Our Service uses a credit-based system powered by Stripe:

Credits are required to use AI generation features
Credits can be purchased through one-time payments or subscription plans
Credit prices are displayed at the time of purchase
All payments are processed securely through Stripe

Refund Policy

Both subscriptions and credit pack purchases are eligible for a refund within 7 days of purchase
Credits that have already been used will be deducted from the refund amount
Refunds will be issued to the original payment method

4. AI-Generated Content

Ownership

Content generated through our Service using your prompts and credits belongs to you. NanoGens AI does not claim ownership over AI-generated outputs created by users.

Limitations

AI-generated content is provided "as is" without guarantees of accuracy, completeness, or fitness for any purpose
You are solely responsible for how you use AI-generated content
You must ensure your use of generated content complies with applicable laws
We do not guarantee that generated content is free from third-party intellectual property claims

5. Acceptable Use

You agree NOT to:

Use the Service for any illegal or unauthorized purpose
Generate content that is harmful, abusive, harassing, or threatening
Attempt to reverse-engineer, exploit, or compromise our systems
Resell or redistribute access to the Service without authorization
Use automated tools to scrape or bulk-access the Service
Circumvent credit requirements or payment systems
Generate content that infringes on third-party intellectual property rights

6. Intellectual Property

The Service, including its design, features, code, and curated prompt library, is owned by NanoGens AI and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.

7. Service Availability

We strive to maintain reliable service but do not guarantee uninterrupted access
We may modify, suspend, or discontinue features at any time with reasonable notice
Scheduled maintenance will be communicated in advance when possible

8. Limitation of Liability

To the maximum extent permitted by law, NanoGens AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Indemnification

You agree to indemnify and hold harmless NanoGens AI from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your access at our discretion if you violate these Terms. Upon termination:

Your right to use the Service ceases immediately
Unused credits are non-refundable upon termination for cause
Provisions that by their nature should survive termination will remain in effect
