NanoGens AI respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond to valid notices of alleged copyright infringement.
1. Reporting Copyright Infringement
If you believe that content available on or through nanogens.ai infringes your copyright, you may submit a DMCA takedown notice to our designated agent with the following information:
- Identification of the copyrighted work you claim has been infringed (or a representative list if multiple works are involved)
- Identification of the infringing material and information sufficient to locate it on our Service (e.g., a URL or description)
- Your contact information, including name, address, telephone number, and email address
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner
- Your physical or electronic signature

3. Our Response
Upon receiving a valid DMCA notice, we may:
- Remove or disable access to the allegedly infringing material
- Notify the user who posted or generated the content
- Terminate accounts of repeat infringers
4. Counter-Notification
If you believe your content was removed by mistake or misidentification, you may submit a counter-notification including:
- Identification of the material that was removed and its prior location
- A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification
- Your name, address, and telephone number
- A statement that you consent to the jurisdiction of the federal courts in Delaware, United States, and that you will accept service of process from the person who filed the original notice
- Your physical or electronic signature
5. Counter-Notification Process
Upon receiving a valid counter-notification, we will:
- Forward the counter-notification to the original complainant
- Restore the removed material within 10–14 business days unless the complainant files a court action
6. Repeat Infringers
We maintain a policy of terminating accounts of users who are repeat copyright infringers. We may, in appropriate circumstances, disable access or terminate accounts at our discretion.
7. AI-Generated Content
Please note that our Service allows users to generate content using AI models. Regarding AI-generated content and copyright:
- Users are responsible for ensuring their use of generated content does not infringe on existing copyrights
- If you believe AI-generated content on our platform infringes your copyright, you may still file a DMCA notice using the process above
- We will review such claims on a case-by-case basis
8. Good Faith
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability. Please ensure your claim is valid before submitting a notice.
